Definitions:
“Ticketflap”, “Us” and “We” mean Asia Ticketing Ltd.
“Site” means the Ticketflap website and all the services connected within
“Host” means the third party supplier of Tickets for Events including, but not limited to: Venues, Artists, Promoters, Event Organisers or others
“Event” means the individual event or events promoted on the Ticketflap site for which Tickets are available
“Tickets” are the right of admission to an Event
“You” means the individual purchasing tickets using this Site
Welcome to Ticketflap.
Ticketflap is a digital ticketing box office platform, which enables Event Hosts to promote and sell Tickets for their Events. At no stage do We purchase the Tickets, set the Ticket prices nor determine the individual Event conditions of sale. We simply collect the Ticket money on behalf of the Host and supply them with the details of Your booking, along with the Ticket revenue. Ticketflap charges You a booking fee for this service. Ownership of the Tickets and rights to grant entry to the Event remain with the Event Hosts and do not pass to Ticketflap at any time.
Please read all of our terms and conditions carefully. By using this site and registering to buy tickets, You will have complied to have agreed and accepted all the terms below.
Registration
To buy Tickets You must be a registered user of the Site. To be a registered user of the Site, You agree to a) provide true, accurate, current and complete information about Yourself as prompted by the Site registration form and b) maintain and promptly update the registration data to keep it true, accurate, current and complete.
You are responsible for all information posted using Your account, including instances where anyone using Your email address and password has accessed the Site. It is Your responsibility to keep Your password secure and protected to prevent such access.
Refunds
In cases where an event is cancelled, or does not take place for any other reason, You will receive a refund from Ticketflap. The amount refunded will be the full ticket price less a refund handling fee and the booking fee paid at the point of purchase will be non-refundable.
If a full or partial refund is requested by You for any other reason, the Event Organiser will review the situation on a case-by-case basis. The decision on whether or not to refund any or all of the ticket price will be at the Event Organiser’s sole discretion.
Refunds will be made back to the card used to make the purchase and will take between 5-7 working days to complete.
Event/Venue Rules and Regulations
Tickets are issued subject to the Rules and Regulations of the Event, issued by the Host and the venue. Full details are available from the Host on request. You and all other Ticket holders in Your party must comply with all relevant statutes, safety announcements and venue regulations whilst attending the Event.
General conditions across all Events:
• Ticket holders must be able to produce acceptable proof of name and age
• The right of admission is reserved by the Event Host and venue. You may be refused entry or ejected for anti-social behavior or other activity deemed inappropriate
• The right is reserved to alter, amend, add, withdraw or substitute Event artists, prices, date, venue, capacity, age restrictions and times
• Recording equipment of any description may not be used without the express written approval of the Event Host
Termination
Ticketflap, at its sole discretion, may terminate Your password, account(s) and/or Your right to use the Site at any time for any reason or no reason, including, without limitation, for lack of use, failure to timely pay any fees or other monies due, or if Ticketflap believes that You have violated or acted inconsistently with the Terms and Conditions herein contained or against the letter of spirit of these Terms and Conditions.
Intellectual Property
The Copyright, trade marks and all other intellectual property rights in the material contained in the Site, belong to Ticketflap and may not be used in any manner without written consent from Ticketflap.
DISCLAIMER OF WARRANTIES.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TICKETFLAP HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. TICKETFLAP MAKES NO WARRANTY THAT: (I) THE SITE WILL MEET YOUR REQUIREMENTS, (II) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE, (IV) THE QUALITY, SAFETY OR LEGALITY OF ANY CONTENT, PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU, OR EVENTS ATTENDED, THROUGH THE SITE, OR THE SERVICES THEMSELVES (OR ANY PART THEREOF), WILL MEET YOUR EXPECTATIONS, OR (V) ANY ERRORS IN THE SITE WILL BE CORRECTED. TICKETFLAP IS NOT RESPONSIBLE AND SHALL HAVE NO LIABILITY FOR THE CONTENT, PRODUCTS, SERVICES, ACTIONS OR INACTIONS OF ANY USER, BUYER OR OTHER NON-ORGANIZER, ORGANIZER OR THIRD PARTY BEFORE, DURING AND/OR AFTER AN EVENT; AND TICKETFLAP WILL HAVE NO LIABILITY WITH RESPECT TO ANY WARRANTY DISCLAIMED IN (I) THROUGH (V) ABOVE. YOU ACKNOWLEDGE THAT TICKETFLAP HAS NO CONTROL OVER AND DOES NOT GUARANTEE THE QUALITY, SAFETY OR LEGALITY OF EVENTS ADVERTISED, THE TRUTH OR ACCURACY OF ANY USERS' (INCLUDING BUYERS', OTHER NON-ORGANIZERS' AND ORGANIZERS') CONTENT OR LISTINGS, OR THE ABILITY OF ANY USER (INCLUDING BUYERS, OTHER NON-ORGANIZERS AND ORGANIZERS) TO PERFORM, OR ACTUALLY COMPLETE A TRANSACTION. THE FOREGOING DISCLAIMERS SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW. Notwithstanding the foregoing, You may report the misconduct of users, Buyers, other non-Organizers, Organizers and/or third parties in connection with the Site to Ticketflap. Ticketflap, at its sole discretion, may investigate the claim and take necessary action.
LIMITATION OF LIABILITY
TICKETFLAP SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES OR UNDER ANY LEGAL THEORY, WHETHER IN TORT, CONTRACT, OR OTHERWISE, WITH RESPECT TO THE SERVICES, OR ANY OTHER SUBJECT MATTER OF THIS TOS, FOR: (I) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF TICKETFLAP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), (II) THE COST OF PROCUREMENT OF SUBSTITUTE SERVICES, (III) AMOUNTS IN EXCESS OF US$100.00 IN THE AGGREGATE FOR ALL CLAIMS WITH RESPECT TO THE SITE, OR (IV) ANY MATTERS BEYOND TICKETFLAP’S REASONABLE CONTROL. TICKETFLAP SHALL HAVE NO LIABILITY WITH RESPECT TO ANY OF YOUR CONTENT OR ANY CONTENT OF ANY OTHER USER OF THE SITE. IN ADDITION, TICKETFLAP IS NOT AFFILIATED WITH, AND HAS NO AGENCY OR EMPLOYMENT RELATIONSHIP WITH, ANY THIRD PARTY SERVICE PROVIDER USED IN CONJUNCTION WITH THE SITE, AND TICKETFLAP HAS NO RESPONSIBILITY FOR, AND HEREBY DISCLAIMS ALL LIABILITY ARISING FROM, THE ACTS OR OMISSIONS OF ANY SUCH THIRD PARTY SERVICE PROVIDER. THE FOREGOING LIMITATIONS SHALL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
RELEASE
IN CONSIDERATION OF BEING PERMITTED TO ACCESS AND USE THE SITE, YOU HEREBY AGREE TO RELEASE TICKETFLAP, AND ITS AFFILIATES, AND EACH OF ITS AND THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, CO-BRANDERS, OTHER PARTNERS, AND EMPLOYEES FROM ALL DAMAGES (WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR OTHERWISE), LOSSES, LIABILITIES, COSTS AND EXPENSES OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH DISPUTES BETWEEN YOU AND THIRD PARTIES (INCLUDING OTHER ORGANIZERS, BUYERS, AND OTHER NON-ORGANIZERS) IN CONNECTION WITH THE SITE,

All information provided by You or collected by Ticketflap in connection with the Services is governed by Ticketflap 's Privacy Policy, a copy of which is located at www.ticketflap.com/privacy which is hereby incorporated by reference into these Terms and Conditions. Ticketflap strongly recommends that You review the Privacy Policy closely. Further, any information submitted or provided by You to the Site may be publicly accessible. You should take care to protect private information or information that is important to You. Ticketflap shall not be responsible for protecting any such information and is not liable for the protection of privacy of electronic mail or other information transferred through the Internet or any other network that You may use. Please be aware that if You decide to disclose personally identifiable information on the Services, this information may become public. Ticketflap does not control and shall not be responsible for the acts of You or any other users (whether Organizers, Buyers, other non-Organizers or otherwise) of the Site.

Ticketflap takes Your privacy seriously. This Privacy Policy explains the steps We take to ensure information about You is kept secure and confidential and complies with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.
Please read this Privacy Policy carefully. Once You use this Website ("Site") or any of Our mobile phone applications ("Apps") or Our services available via it or them You will be deemed to have read and consented to the uses of Your personal data set out in this Privacy Policy. You will also be deemed to have read and accepted this Privacy Policy and the Website terms and conditions of use ("Terms and Conditions").

1. Your Details And The Purposes For Which Information Is Used

1.3 This personal information and any other information You provide to Us via the Site or any Apps is required in order to process Your order, manage Your Member registration with us and to provide You with information and offers about Events and Event Hosts.
1.4 On registering with us You will be able to view Your registration details through the My Account page using Your email address and the password You have chosen.
1.5 You will be able to edit all the details You have given Us through the My Account page by using Your email address and password.
2. Passing On Your Details
2.1 In processing Your order, We will only pass on personal information about You to third parties such as is necessary to enable Us to process the payment for Your order and to fulfill Your order, restricted to those third parties such as the Hosts of any events for which You have bought a ticket.
2.2 We will use Your name, email address and any interests or preferences You provide to Us to keep You informed of forthcoming Events and offers relating to Events and Event Hosts. You may withdraw Your consent for the provision of this information at any time either through the My Account page or by unsubscribing via the newsletters.
2.3 Furthermore, We may, only with Your prior consent, pass on Your personal information and any interests or preferences You provide to Us to Event Hosts, who may contact You directly with marketing materials about their events and offers. Once You have given consent You can, at any time, ask Us to cease passing on Your personal information (by sending an email to contact@ticketflap.com), and You may ask any third parties to whom Your information has been passed to cease using Your personal information.
2.4 We may disclose information about You if You breach or if We suspect You may have breached this Privacy Policy or the Terms and Conditions. We may also disclose Your details if required to do so by law or requested to do so by any Governmental or law enforcement agency.
2.5 In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform certain services they provide to us.
Certain third-party services, such as payment gateways and other transaction or payment processors are required to abide by security standards imposed on them, such as the Payment Card Industry Data Security Standard (PCI-DSS), which is a set of security standards designed to ensure that all payment processors that accept, process, store or transmit credit card information maintain a secure environment. All direct payment gateways we utilise adhere to PCI-DSS, which is a joint effort of brands like Visa, MasterCard, American Express and Discover, to safeguard card data handling.
Whilst we shall not store your credit card information, such payment gateways and other transaction or payment processors, under PCI-DSS, may store your purchase transaction data for only as long as is necessary to complete the transaction and thereafter for only as long as it is required by law.
Such third-party payment gateways and other transaction or payment processors and other third parties, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

3.1 All payment processing and transactions are done via a secure server and data transmissions are protected using SSL encyrption.
3.2 Whilst We strive to protect Your personal information, no data transmission over the Internet can be guaranteed to be totally secure and therefore We cannot ensure or warrant the security of any information You send to us. You provide us with information via this Site at Your own risk.
3.3 We do not store your payment card information which is handled entirely by our payment processors.

4.1 Our Site uses 'Session cookies' which track Your browser session. These do not store any information on Your computer but merely allow our Site to recognise Your order and its contents and whether You are logged in to Your account.

We have the right to charge a reasonable fee for the processing of any data access request.

8. Governing Law
These Terms and Conditions and Privacy Policy shall be governed by the laws of the Hong Kong Special Adminsitrative Region of the People's Republic of China.

What Personal Data might we collect about you?

When do we collect your Personal Data?
We may collect Personal Data about you in various cases, such as for example:
- When you or your business seek our products or services or use any of our online services, including but not limited to setting up an account through our websites;
- When you or your organization make an enquiry through our website, in person, over email or over the telephone, including but not limited to applying for a position with us;
- When you attend an event we may organize, or sign up to receive communications from us;

- When you or your organization provide us with feedback;

How will we use your Personal Data?
We will use your personal data, for the following purposes (“Permitted Purposes”):
- Where we need to perform the contract we are about to enter into or have entered into with you;

With regard to newsletters, legal updates, and other general communications, you will always have the option to opt out of receiving such communications at any time.
Information on our promotional offers
We may use your Identity, Contact, Technical, Usage and Profile Data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you (we call this marketing). You will receive marketing communications from us if you have consented to it or if you have requested information or purchased services from us or if you provided us with your details when you entered a competition or registered for a promotion and in each case, you have not opted out of receiving marketing communications.
Treatment of third-party marketing
We will always get your express opt-in consent before we share your Personal Data with any company outside the Melco Group for marketing purposes.
Legal grounds for processing
Depending on which of the above Permitted Purposes we use your Personal Data for, we may process your personal data on one or more of the following legal grounds provided for under applicable data protection legislation:
- Where processing is necessary for the performance of a contract with you or your organization;
- Where we need to comply with a legal or regulatory obligation;
- Where it is necessary for our or our contractors’ (where applicable) legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;
- When we have your consent to do so, where you have expressly given this to us.
How might we share your Personal Data?
We may disclose your personal data where we may instruct service providers within or outside the Melco Group, domestically or abroad, e.g. IT services or server providers, to process Personal Data for the Permitted Purposes on our behalf and in accordance with our instructions only. In certain cases, this may also mean that your Personal Data may be transferred to locations outside Macau. We will retain control over and will remain fully responsible for your personal data and will use appropriate safeguards as required by the applicable laws to ensure the integrity and security of your Personal Data when engaging such service providers;
We will otherwise only disclose your Personal Data when you direct us or give us permission to do so or otherwise as required by law, such as for meeting legal and tax obligations.
Transfers of Personal Data abroad
We are active across the world – this means that we may transfer your Personal Data abroad if required to do so for the Permitted Purposes. In certain cases, this may include transferring data to countries which do not offer the same level of protection as the laws of your country or Macau (such as for example the data protection legislation of Macau).
When making such transfers, we will ensure that they are subject to appropriate safeguards in accordance with the Macau Personal Data Protection Act (Law 8/2005) or other relevant data protection legislation, or that we otherwise comply with the requirements and standards under the Macau Personal Data Protection Act (Law 8/2005) for transferring Personal Data abroad. Can you refuse to share your personal data with us?
In general, we receive your Personal Data where you provide this on a voluntary basis, and there will typically be no detrimental effect for you if you wish not to provide this or otherwise withhold your consent for it to be processed. However, there are certain cases where we will unfortunately be unable to act without receiving such data, for example where we need to carry out legally required compliance screening or require such data to process your instructions or orders, or otherwise to provide you with our online services or communications.
Where it is not possible for us to provide you with what you request without the relevant Personal Data, we will let you know accordingly.
How do we keep your Personal Data safe?
We have put in place appropriate security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your Personal Data to those employees, agents, contractors, and other third parties who have a business need-to-know only. They will only process your Personal Data on our instructions and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach in accordance with the applicable legal procedures.
Personal Data we receive from you about other people
Where you provide us with the Personal Data of other people, such as your employees, directors of your companies, or other persons you may have personal or professional dealings with, you must ensure that you are entitled to disclose that Personal Data to us and you acknowledge to us that you have obtained any consents from those people and any authorizations as may be required under any applicable laws to provide us with such Personal Data, without us being required to take any further steps to collect, use, and disclose that Personal Data in the manner described in this Privacy Policy.
How long do we keep your personal data for?
We delete your Personal Data once it is no longer reasonably necessary for us to keep it for the Permitted Purposes or, where we have relied on your consent to keep your personal data, once you withdraw your consent for us to do so, and we are not otherwise legally permitted or required to keep the Data.
Importantly, we will keep your Personal Data as necessary for the purposes of defending or making legal claims until the end of the period during which we may retain the Data and otherwise until the settlement of any such claims, as relevant.

What rights do you have?
Subject to certain circumstances under the applicable legislation, you have the right to:
- Request a copy of the Personal Data which we hold about you or in certain cases request us to transfer the Data we hold about you to another provider;
- Have any inaccurate Data we hold about you corrected;
- Object or restrict our use of your Personal Data;
